A Gold Star hearing was videoconferenced from Toronto Apr 29 to other courtrooms across Canada. With Plaintiffs representing those with extended MMAR ATPs but unhappy about it, ATP Left-Outs, Never-Ins (Terry Parker) and healthy me, Justice Phelan dismissed all motions for "insufficient evidence" of medical need. The Old Filers. He also stayed all new similar actions too even if new files have provided much more and sufficient evidence of medical need. The New Filers. But all may still ask for his leave to move for Interim Exemption.

STEPS FOR NEW FILERS: (after Apr 29 2014)

1) File FCC Statement of Claim MMPRSC without Allard communalities. 
2) File FCC Motion N13 for leave for interim exemption.

STEPS FOR OLD FILERS: (before Apr 29 2014)

If you filed a motion that was dismissed by Phelan J. for insufficient medical evidence and your action stayed due to the Allard bugs: 
1) File N12A Notice of Appeal to FCA of stay and dismissal.
2) File N12 Motion to FCA for interim exemption.

If you did not file a motion that was dismissed by Phelan J. and action stayed for Allard bugs:
1) File new FCC Statement of Claim without Allard communalities. It will be rejected. You tried to get of the bugs.  
2) Like Bugless New Filers, now file FCC Motion N13 to Phelan for leave to present your sufficient medical evidence for interim exemption.

FILING THE STATEMENT OF CLAIM

Every Action starts with an originating Statement of Claim with 4 copies mailed or delivered to the Registrywith the $2 fee. But why do all that printing when it can all be done online for free? The Registry serves the Attorney General the originating document and sends you your Statement of Claim with Gold Star.

The Motion Record for interim exemption for Personal Medical Use with your Affidavit of medical need for New Filers and Old Filers without previous dismissed motions, put the T-File on your Motion Record, fill in the usual blanks but leave the date sought in FCC blank in the Notice.
Written Representations or Memorandum: Tick your category of Plaintiff.
Affidavit: To add an Exhibit (picture, photocopy) just mention it in your Affidavit: Exhibit 1 is the picture of my cancer.. Add as many exhibits as you want. Judge wants proof, give it. Your Affidavit has damages computed. Do not sign the Affidavit until you are before the clerk or a commissioner or notary of oaths. You're not arguing your issues, only for interim medical exemption while the fight.

The FCC Letter to Administrator asking for a date for a telephonic conference call hearing to explain how you need your herb. It has to be served separately on the Crown like the Motion and mentioned in the Affidavit of Service.

FREE COMMISSIONERS OF OATHS

Federal Court clerks, Post Masters (not clerks), Priests, Branch Bank Manager, Justice of the Peace, "in addition to appointments, some professionals are automatically Commissioners of Oaths, including barristers of the Supreme Court of Nova Scotia, Canadian Armed Forces officers on active duty, MLAs, municipal chiefs of police, all RCMP members and funeral directors." (off the ns gov website) I've always just asked a suit at the courthouse: "Could you commission my oath?" If they're a lawyer, most will say sure and take the 15 seconds to watch you sign and then sign too.
